Notice of Necessary Nighttime Work

Notice of construction work outside of standard 7am - 7pm construction hours

Firelands Wind, LLC (“Firelands Wind”) and Apex Clean Energy hereby give notice, pursuant to Ohio Administrative Code 4906-4-09 (F)(1) of necessary nighttime construction activity for the Emerson Creek Wind Project (“Project”)in Huron and Erie Counties.

In accordance with these regulations, Firelands Wind is sending notice to all owners and residents within and immediately adjacent to the relevant portions of the Project that may be affected by this activity.

This nighttime construction activity notice covers the following:

Installation of Main Power Transformers

To properly and safely install the Project’s two main power transformers, a strict uninterrupted procedure must be followed which will involve up to 72 hours of continuous work. For this reason, Firelands Wind is giving notice that it will be necessary to exceed the time-of-day restrictions on construction activity (seven a.m. to seven p.m.) on two occasions.  The transformers are scheduled to arrive on site between October 13th and 15thand the installation is expected to take place in the days after their arrival.  

These procedures do not require loud equipment; therefore, it will not increase noise above ambient levels at sensitive receptors.  No impact pile driving, hoe ram, blasting, or other similar high-noise construction activities will occur during the extended hours. Work conducted outside the certificated construction hours will be limited to the minimum activities necessary to complete the MPT dress out procedures.

Temporary lighting will be, to the maximum extent practical, directed only towards the work area and away from nearby residences. All such lighting will be turned off as soon as the work is completed.

Completion of In-Progress Turbine Erection

To safely complete turbine erection, Firelands Wind may need to exceed time-of-day restrictions where necessary to finish already started installation of large components.

Once erection of a turbine section begins, it must be completed to ensure worker safety.  Put differently, turbine sections and other large pieces of equipment, once elevated into the air, must be properly installed and secured to ensure the safety of crews working on that tower and of anyone else in the general vicinity.

For this reason, Firelands Wind is giving notice that it may be necessary to exceed the 7:00p.m. end-of-work restriction to complete installation of a turbine section or particular component.  

Firelands Windwill not begin any construction activity after 7:00 p.m.; instead, thisnotice is limited to situations where erection of a tower section or otherturbine component began during normally authorized hours and is not yet at asafe completion point by 7:00 p.m.  Insuch scenarios, Firelands Wind will continue construction activity only asnecessary to reach a safe point of installation where construction activity cansafely end for the day and resume the next morning.

Any suchconstruction activity that exceeds the 7:00 p.m. end of day cutoff will notincrease noise above ambient levels at sensitive receptors.  No impact pile driving, hoe ram, blasting, orother similar high-noise construction activities will occur during the extendedhours.

There will be no crane walking or other movement of heavy equipment from one turbine foundation to another outside of normal construction hours.

Work conducted outside the certificated construction hours will be limited to the minimum activities necessary to complete the active erection sequence or reach a safe stopping point.

Temporary lighting will be, to the maximum extent practical, directed only towards the work area and away from nearby residences. All such lighting will be turned off as soon as the work is completed.
